The $137 Million AI Ad Flood Is Reshaping the 2026 Midterms

AI-generated political ads have exploded from under $50,000 in 2024 to more than $137 million in 2026, and only 27% carry a disclaimer. Here is what campaigns, voters, and strategists need to know right now.

American political advertising has officially entered its AI era, and the numbers are staggering. Political campaigns and groups have spent more than $137 million airing ads created at least partly with AI tools ahead of the 2026 midterm elections, according to new data from the Wesleyan Media Project.

For comparison, the same researchers identified less than $50,000 in spending on AI-generated ads during the entire 2024 cycle. "AI is making its way into the 2026 midterms in a big way this year," Erika Franklin Fowler, co-director of the Wesleyan Media Project, said in a news release. "Much of the AI use is not disclosed through any type of disclaimer."

How Big Is the AI Ad Surge in the 2026 Midterms?

The Wesleyan Media Project has identified 220 political ads across 34 states that used AI tools, with spending topping $137 million. Only 27% of those ads included a disclaimer telling viewers the content was AI-generated. Republican candidates and groups accounted for 81% of the identified ads and 88% of the spending, while Democrats sponsored just 12%.

According to the New York Times, more than 80 percent of the ads were produced by Republican campaigns or Republican-aligned political action committees. Many of them use AI to make opponents appear alongside polarizing Democratic figures such as Hillary Clinton or Alexandria Ocasio-Cortez.

Fowler told reporters the trend has surprised even veteran ad watchers. "I think what we're seeing with AI has surprised even us," she said. "Some of the ways in which AI is used, honestly, if there wasn't a disclaimer on the ad, it would be hard to know that AI was there."

What Are States Doing About AI Deepfakes in Elections?

With no federal rules on AI ads in place, states have rushed into the gap. By June 2026, 31 states had enacted laws regulating election deepfakes, according to Campaigns & Elections magazine. Twenty-eight generally require disclosures on synthetic political media, while Colorado and Utah add metadata requirements.

Minnesota and Texas prohibit certain political deepfakes during defined pre-election periods. Maryland applies a year-round prohibition, and Maine joined the field in 2026 with a law requiring disclaimers on materially manipulated or AI-generated campaign media.

Enforcement remains the weak link. In California, where the governor's race has put AI campaign ads in the spotlight, Democratic state Senator Tom Umberg told ABC10 that voters deserve transparency. "Voters deserve to know what's been manipulated," Umberg said. "The fact that there's not sort of immediate intervention is concerning."

New York Attorney General Letitia James released an updated voter guide this month warning that AI fakes have improved so much they may have no obvious flaws. Her office urged voters to be skeptical of emotional or shocking content and to avoid sharing anything suspicious without confirmation.

Can Campaigns Use AI Without Crossing Legal or Ethical Lines?

Yes, but the line is getting thinner. Straight Arrow News reports that AI-generated deepfakes of political candidates have reached new highs this cycle, and some targets are now pursuing defamation claims against rivals who fabricated their likenesses. Laws in 31 states have not stopped the surge.

The legitimate uses are real and powerful. As Campaigns & Elections notes, campaigns can use generative AI to draft scripts, translate messages, generate images and voiceovers, clone approved creative into hundreds of audience-specific variations, and optimize delivery. Those same efficiencies increase the chance that synthetic depictions will be mistaken for real speech.

Smart campaigns are treating disclosure as a strategic asset rather than a burden. Voters punished deceptive tactics in past cycles, and transparency builds the trust that persuasion depends on. Tools like HyperPulse synthetic polling can help campaigns test how voters react to AI-assisted messaging before it airs, while disciplined HyperPhonebank outreach keeps human conversation at the center of voter contact. Is This Only an American Problem?

Far from it. Nigeria's Independent National Electoral Commission has set up a dedicated AI unit to detect deepfakes and protect its 2027 elections, Businessday NG reports. INEC chairman Joash Amupitan warned at the Artificial Intelligence and Democracy Forum 2026 in Abuja that generative AI, synthetic media, targeted advertising, and algorithmic bias are emerging threats to election administration.

"Algorithms will not, and must never, decide the 2027 vote," Amupitan declared, according to Politics Digest. He warned of the danger extending beyond infrastructure attacks to what he called the hacking of voters' minds through digitally manufactured falsehoods.

Amupitan added that protecting the 2027 elections would require more than sophisticated technology. The credibility of the process, he stressed, would depend on transparency.

What Should Campaigns and Voters Do Next?

The strategic picture for 2026 and beyond is clear. AI lowers the cost of persuasion and deception alike, disclosure rules vary wildly by state, and no federal baseline exists. Campaigns that build transparent AI workflows now will hold a durable advantage over rivals who treat synthetic media as a shortcut.

For voters, the guidance from election officials is consistent: slow down, verify, and assume nothing. For campaigns, the mandate is equally clear. Pair AI-powered creative with authentic human outreach, rigorous compliance review, and real-time voter data from resources like the Election Data Hub.

The AI slop era is here. The campaigns that win in 2026 and 2028 will be the ones that harness the technology without surrendering their credibility.
